Terms of Service

1. Acceptance of Terms

By creating an account or using any part of the Service, you confirm that you are at least 18 years old, have the legal authority to enter into this agreement, and accept these Terms in full. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. Description of Service

InsuranSync is a cloud-based lead and team management platform designed for life insurance agents and organizations operating in the Philippines. Features include, but are not limited to:

• Lead pipeline tracking and status management
• Agent team creation and management for enterprise accounts
• Policy and commission tracking
• Reports and analytics dashboards
• CSV and Facebook JSON lead imports

We reserve the right to modify, suspend, or discontinue any feature of the Service at any time with reasonable notice.

3. Accounts and Registration

You must provide accurate, complete, and current information when creating your account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. Notify us immediately at hello@insuransync.com if you suspect unauthorized access. We are not liable for any loss resulting from unauthorized use of your account.

4. Subscription and Payment

InsuranSync is offered on a subscription basis. Fees are billed monthly or annually as indicated at the time of purchase. All fees are in Philippine Peso (PHP) and are exclusive of applicable taxes.

• Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Refunds: Fees are non-refundable except as required by applicable law or at our sole discretion.
• Price changes: We will notify you at least 30 days before any price increase takes effect.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation, including data privacy laws
• Upload or transmit unauthorized, fraudulent, or misleading lead data
• Reverse-engineer, decompile, or attempt to extract source code
• Interfere with or disrupt the integrity or performance of the Service
• Share account credentials with unauthorized third parties
• Use the Service to send unsolicited communications (spam)

We reserve the right to suspend or terminate accounts that violate this section without prior notice.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You are solely responsible for ensuring that the personal data you upload into the Service (including lead information) is collected and processed in accordance with Republic Act No. 10173 (Data Privacy Act of 2012) and all other applicable laws.

7. Intellectual Property

All content, trademarks, logos, and software comprising the Service are the exclusive property of InsuranSync or its licensors. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it as described herein. You retain ownership of all data you input into the Service.

8. Termination

Either party may terminate this agreement at any time. You may cancel your subscription through the account settings page. Upon termination, your right to access the Service ceases immediately. We will retain your data for 30 days after termination, after which it may be permanently deleted. You may export your data prior to termination.

9. Limitation of Liability

To the fullest extent permitted by law, InsuranSync and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the appropriate courts of Makati City, Metro Manila, Philippines.
